Marine accused in fatal shooting makes court appearance

A Marine accused of fatally shooting of a man last week appeared in court Monday morning.

Cpl. Benjamin Marisic, 24, of 713 Savannah Drive made his first appearance in court for a charge of murder, according to court documents.

At his first appearance, Marisic waived the right to counsel and chose to hire an attorney for his preliminary hearing, which is scheduled for Aug. 29.

Monday, he was held at the Onslow County Jail without bond.

According to warrants, authorities said Marisic, “did of malice aforethought kill and murder” 39-year-old Crestview resident Dale Fonso Smith.

Smith was found dead by Jacksonville police, who had responded to reports of a shooting at a home on Savannah Drive about 3:47 a.m. Friday.

The house, which Marisic owns, is in the Carolina Forest neighborhood, according to county documents.

Smith worked as a civilian contractor, authorities said.

Marisic is an active-duty Marine stationed aboard Camp Lejeune with 3rd Battalion, 2nd Marine Regiment.

Naval Criminal Investigative Service also is working on the investigation with Jacksonville police.
